State Sen. Tom McClintock's congressional campaign said opponent Charlie Brown's new campaign mail piece uses media photos without the media outlets' permission.
The campaign for McClintock (R-Thousand Oaks) said Brown's mailer features photos of McClintock taken by the Sacramento Bee and The Associated Press without permission from those media outlets.
"Hypocritical Charlie Brown is fond of reciting the Air Force Code and lecturing others to follow its admonition that ‘I will not lie, cheat or steal nor tolerate those who do,'" McClintock campaign spokesman Bill George said in a press release.
That stance contrasts with what's in his campaign piece, George said in the release.
George said he's confirmed with both the Bee and AP that Brown's campaign did not ask for or receive permission to run the photos.
Todd Stenhouse, Brown's campaign manager, said the charges are "just silly."
"All those photos are publicly available on the Internet, and Tom McClintock is a public figure," Stenhouse said. "It's called fair use."
He questioned why McClintock, who moved from Southern California to the 4th Congressional District that he and Brown, a Roseville Democrat, seek to represent, wouldn't want his face before voters.
"Why won't he talk about the issues, such as about why he tried to deny health care coverage for millions of California residents with pre-existing conditions?" Stenhouse said. "Tom McClintock doesn't want to talk about those issues because he's part of the problem."
Stenhouse said that neither the Bee nor AP had contacted the campaign to say the photos were being used improperly.

A joke? Here's a joke for you.
What's the only thing you can't call Tom McClintock in the the fourth California district?
You can call him a professional politician, a carpet bagger, and a chicken-hawk.
But you can't call him a native son.
Jimmy-- wrong again
Charlie Brown is the only candidate to talk about children's health. Over 100,000 people in the 4th District are veterans, and we all know Charlie talks about veterans aftercare. He's the only candidate to have a comprehensive economic plan. In fact, just this morning SignOnSanDiego had an interesting note about Tom's lack of action on the issue: http://weblog.signonsandiego.com/weblogs/afb/archives/028066.html
Charlie's the only candidate to come out with policy papers on his website-- not just one liners like Tommy Boy. Sorry to burst your bubble, Jimmy, but your candidate is losing ground and getting desperate.
Mike- I'm sorry but Charlie
Mike-
I'm sorry but Charlie has never spoken about issues. His mail, radio and TV is devoid of issues. At least everyone knows what McClintock believes, unlike Charlie who either won't take a position or tries to take multiple positions on an issue (agreeing with whoever he is talking to at the moment). So, your get back to the issues statement is particularly false because that is the last thing Liberal Liar Charlie has ever wanted to talk about.
What has Charlie got- falling further behind in the polls and now signing every liberal pledge he can find? Now I get two bad mailers in the same day. His ad's that are absurd on their face (Yeah right- McClintock- the guy you criticize for never raising taxes is going to raise taxes- right. McClintock- who has never voted to raise taxes in 22 years and is the Chair for the No New Tax caucus is secretly planning to raise taxes 23%). Charlie is a joke at this point.
Published photos are in the public domain.
That's the best the McClintock campaign has? After they ripped off Brown's web site vet's information?
